Supplementary affidavit filed by the learned counsel for the applicant today in the Court is taken on record.
Sri R.C. Yadav, learned counsel has put in appearance on behalf of opposite party no.2 by filing his Vakalatnama today in the Court, which is taken on record.
Heard Sri Vijay Pratap Singh, learned counsel for the applicants and Sri R.C. Yadav, learned counsel for the opposite party no.2 and Sri Sanjay Singh, learned A.G.A.-I for the State.
This application under Section 482, Cr.P.C. has been filed for quashing the proceedings of Complaint Case No.2557 of 2017 (Smt. Sushil Vs. Chandra Pal alias Banti & Ors.), under Sections 498-A, 323 I.P.C. and 3/4 D.P. Act, Police Station Amroha Dehat, District Amroha, pending before 2nd Additional Civil Judge S.D./A.C.J.M., Amroha.
It is contended by learned counsel for the applicants that the applicant no.1 is the husband, applicant nos.2 and 3 are the mother-in-law and father-in-law of the opposite party no.2. It is further submitted that the matter which is a matrimonial dispute has been compromised between the parties, copy of which has been filed as annexure-SA-1 to the supplementary affidavit dated 7.10.2018.
Sri R.C. Yadav, learned counsel for the opposite party no.2 also stated that the compromise has enter into between the parties.
Learned A.G.A. prays for and is granted four weeks time to file counter affidavit. Opposite party No. 2 may also file counter affidavit within the same period.
In the meantime, the applicant may file the compromise entered into between the parties, before the court below within a period of fifteen days from today who shall verify the same within three months after issuing notice to the signatories of the compromise, under intimation to this Court.
List after three months.
Till the next date of listing, coercive action against the applicants in the the aforesaid case shall be kept in abeyance.
