ORDER:
Heard.
2. Petitioner, which is a cooperative house building society, questions inaction of the respondents on the objections filed by them dated 23.09.2014 and 09.10.2014 objecting to grant of license in favour of the fourth respondent for opening a toddy shop in plot No.6, which is part of the layout of Chandra Nagar Co-operative House Building Society Limited, Rasoolpura, Secunderabad.
3. Learned Assistant Government Pleader has received instructions from the Prohibition and Excise Superintendent, Secunderabad, wherein it is specifically stated as under:
1. No application has been received for establishment of toddy shop in Plot No.6/part or in any plot of the layout of the Chandranagar Cooperative House building Society limited, Rasoolpura, Secunderabad.
2. Further, it is to submit that no toddy shop licence has been issued in Plot No.6/part or in any plot of the layout of the Chandranagar Cooperative House building Society limited, Rasoolpura, Secunderabad.
4. In view of the above, therefore, since there is no application for establishment of toddy shop at the place objected to by the petitioner and since no license is granted to anybody, the cause of action in the writ petition does not survive.
The writ petition is accordingly dismissed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
