Chandra Mukhi vs Awas Vikas Parishad And 3 Others

High Court Of Judicature at Allahabad|31 January, 2019

JUDGMENT / ORDER

Heard counsel for the petitioner and Sri S.K. Mishra for respondents no.3 and 4.
The only prayer which has been pressed by learned counsel for the petitioner is for issuing direction to the trial court to decide application for temporary injunction pending in Original Suit No.1813 of 2018.
The suit referred to above has been instituted by the petitioner against the defendant-respondents. The trial court by order dated 23.8.2018 declined to grant exparte injunction. The defendants have yet not been served.
Learned counsel for the petitioner submitted that there is an extreme urgency, as the defendants are in a hurry to auction the property.
The petition is disposed of by directing the trial court to make serious endeavour to decide the application for temporary injunction expeditiously, soon after service is found to be sufficient upon the defendants.
