Heard Sri Vinod Kumar, learned counsel for the petitioner and Sri Vivek Kumar Rai, learned counsel appearing for the Railways.
The petitioner has preferred this writ petition against the order dated 14.12.2017 passed by the Central Administrative Tribunal (in short CAT) Allahabad by which the application of the petitioner for interim relief has been disposed of.
The dispute before the tribunal is about the inter se seniority of the petitioner vis-a-vis the other employees. The petitioner had not applied for any interim relief initially subsequently when an application for interim relief was filed, it was got dismissed. Later on when the present application for interim relief was filed, the tribunal has observed that it is not in the interest of justice that application for interim relief be heard and decided on merits rather it will better to decide the original application on merit and the application for interim relief has been disposed of making it clear that any promotion made from the tentative seniority list shall be subject to the final decision of the original application.
In view of the above, the interest of the petitioner stands duly protected and that the petitioner can get the original application itself decided at the earliest.
It goes without saying that the tribunal had fixed a date for final hearing of the original application but it is informed that on the said date the matter was adjourned.
In view of the aforesaid facts and circumstances, we dispose of the writ petition without interfering with the order impugned expecting the tribunal to proceed and decide the original application itself on merits in accordance with law most expeditiously without granting any unnecessary adjournment to either of the parties.
