The challenge in the instant petition is to an order of suspension. The Court had taken cognizance of the complaint that although nine months have passed, no chargesheet has been issued. Alongwith a short counter affidavit which has been filed in these proceedings, the respondents have brought on the record a chargesheet which is stated to have been issued on 29 August 2021.
Bearing in mind the nature of allegations which are levelled in the order of suspension and that forms the basis for drawl of disciplinary proceedings, although the Court refuses to interfere with the same, this petition shall stand disposed of with a direction to the disciplinary authority to ensure that the proceedings which have been initiated shall be concluded with expedition and in any case within a period of three months from today. It is further clarified that the time frame stipulated above is subject to the petitioner cooperating in the proceedings and not taking any unnecessary adjournments.
