Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed with a prayer that the Court below i.e. Civil Judge (Junior Division), Shahganj District Jaunpr be directed to expedite the hearing and decide the Misc. Case No. 105 of 2007 (Chandra Ketu vs. Mahendra Tiwari) filed under Order 39 Rule 2A CPC within a time bound period.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the Civil Judge (Junior Division), Shahganj District Jaunpr to expedite the hearing of the aforesaid case and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of six months, provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties.
With the aforesaid observations/ directions, the present petition is finally disposed of.
