Sri K. R. Singh and Sri D. N. Misra, learned Standing Counsels, appearing for the opposite parties and also for the Principal Secretary of Secondary Education and the Director of the Secondary Education have stated that on account of certain lack of communication on their part the detailed order of this Court dated 4.12.2009 could not be communicated to the said authorities. It has further been stated that they have received instructions through Smt. Neena Srivastava, Joint Director of Education (Finance)(Secondary) who is present in Court that the directions contained in the judgment and order dated 15.1.2009 and the order dated 4.12.2009 shall be complied with within a week and the due payment shall be made to the applicant within the same time. Although the order dated 4.12.2009 provided that in case compliance is not made the Principal Secretary of Secondary Education and the Director of the Secondary Education shall remain present on the next date fixed which is today but on account of request made by the learned Standing Counsel as stated above, as a last opportunity one week further time is allowed to make full compliance.
List this case on 18th January, 2010.
By the said date if the affidavit of full compliance is not filed either by the Principal Secretary or the Director of the Secondary Education both the said authorities shall remain present before this Court.
