Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
Petitioner is before this Court with a request commanding the Commissioner, Azamgarh Division, Azamgarh to decide the Stay Application dated 16.10.2018 pending in Appeal filed by the petitioner under Section 13(1) U.P.Essential Commodities (Regulation of Sell and Distribution) Control Order 2016, expeditiously within a stipulated period of time as fixed by this Hon'ble Court.
Learned Standing Counsel fairly states that in case the aforementioned application is still pending and has not been decided, the same will be considered and decided expeditiously by the Authority concerned.
In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the Commissioner, Azamgarh Division, Azamgarh to decide petitioner's aforesaid application by a speaking order within a period of three weeks from the date of production of a certified copy of this order before him.
