The petitioners was granted agricultural lease by the resolution dated 15.10.1993 of the Land Management Committee. However, the said lease was cancelled by the Additional Collector, Fatehpur vide his order dated 25.7.2018. Against the order dated 25.7.2018, the petitioner filed a revision before the Board of Revenue, U.P at Allahabad which is numbered as Revision No.2078 of 2018 (Computer Case No.AL 20180225002078)(Chandra Gupt and others versus State).
In the aforesaid revision, the Board of Revenue initially granted an interim protection to the petitioners and the said interim order was subsequently extended but could not be extended after 27.8.2019. It has been stated in the writ petition that the application dated 27.8.2019, 19.11.2019 and 11.2.2020 filed by the petitioners for extension of the interim order have not yet been decided and no orders could be passed on the aforesaid application.
Consequently, the petitioners have filed the present writ petition with a prayer to command the Board of Revenue, U.P at Allahabad to pass appropriate orders on the stay application dated 27.8.2019, 19.11.2019 and 11.2.2020 and also to decide Revision No.2078 of 2018 (Computer Case No.AL 20180225002078) within a fixed time.
It would serve no useful purpose to direct the Board of Revenue, U.P at Allahabad to pass appropriate orders on the stay application filed by the petitioners. The Board of Revenue is directed to decide Revision No.2078 of 2018 (Computer Case No.AL 20180225002078) expeditiously preferably within a period of one year from the date a copy of this order is produced before it, in case, there is no legal impediment in deciding the aforesaid revision.
Till the decision of the Board of Revenue, U.P at Allahabad, parties shall maintain status quo and the petitioners shall not be evicted from the disputed plots.
With the aforesaid directions, the writ petition is disposed of.
