The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the judgement and order dated 16.07.2021 passed in Writ C No.15043 of 2021 (Chandra Bhooshan Vs. Bharat Petroleum Corporation Ltd.).
An affidavit of compliance was filed by Sri Anand Tiwari, learned counsel for the opposite party, same is taken on record. It is stated in paragraph 5 of the affidavit of compliance that the order passed by the writ court has already been complied with and decision has been taken on 25.10.2021, copy of which is appended as annexure 1 to the affidavit.
In this view of the matter, Court is of the opinion that the order passed by the writ court has been complied with, therefore, no cause of action remained survive.
In view of the same, the present contempt application is dismissed. However, in case applicant is still aggrieved it is open for the applicant to approach the appropriate forum, if so advised.
