Heard learned counsel for the petitioner; learned Standing Counsel for respondents 1 to 3 and perused the record.
The prayer made in this petition is to direct the second and third respondents to restrain the respondents 5 and 6, who are private individuals, from running R.O. water plant at Friends Colony, Arya Nagar, Hathras.
It appears that for the same relief, the petitioner has instituted suit no.213 of 2017. In the said suit, an interim injunction application 7C2 was filed, which was rejected by the trial court against which an appeal was preferred which was partly allowed by order dated 12th August, 2020, passed by the District Judge, Hathras.
As the petitioner is already pursuing remedy before the civil court, we decline to entertain this petition by leaving it open to the petitioner to seek appropriate relief before the civil court.
Subject to above, the petition stands disposed off. Order Date :- 5.1.2021.
