1. Heard learned counsel for the petitioner.

The petitioner has challenged the order dated 9.7.2019 passed by the appellate authority partly allowing the appeal of the petitioner against the cancellation order dated 2.4.2018 on the grounds of principles of natural justice and directing the matter to the Licencing Authority to consider afresh after giving opportunity of hearing to the petitioner and after considering his reply/objections to the show cause notice.

The petitioner is aggrieved by the direction issued by the learned Commissioner to the effect that till disposal of the matter relating to fair price shop licence of the petitioner, the current dispensation with regard to distribution of essential commodities shall continue in the village in question.
4. It has been submitted by the learned counsel for the petitioner that after the order of cancellation of fair price shop licence was set aside by the appellate court, no such order could have been passed.
5. I have perused the order impugned and I do not find any good ground to show interference in the same as the appellate authority has also fixed a time limit for disposal of the entire case by the Licencing Authority within one month from the date of passing of the order and detailed directions have also been issued with regard to how the hearing has to be conducted.
6. The writ petition is disposed of with a direction to the Sub Divisional Magistrate to strictly follow the directions of the appellate authority and dispose of the case of the petitioner within the time limit prescribed.
