1.0 The petitioner herein has prayed for appropriate directions to respondents to construe, interpret and read the provisions of Rule 5(1) & (2) of Rules for admission to MBBS and other courses in Government, Municipal, GrandinAid and Self Financed Colleges or Institutions in the State of Gujarat after HSCE (12th) Science Stream (B/AB Group) and GUJCET 201213 and hold that the petitioner is eligible for admission to such courses and to include his name in the merit list prepared for the purpose of admission to the course of MBBS and other Courses. 2.0 It is brought to the notice of this Court that similar petition being Special Civil Application No.8925 of 2012 came to be filed before this Court praying for similar relief. The said petition was dismissed by learned Single Judge vide order dated 06.07.2012. Against the said order Letters Patent Appeal No. 921 of 2012 was filed.
3.0 In the present petition on 11.09.2012 Rule nisi was issued, but interim relief was refused. Therefore the present petitioner preferred Letters Patent Appeal No. 1094 of 2012 before the Division Bench.
4.0 Both the aforesaid appeals being Letters Patent Appeal No. 921 of 2012 and Letters Patent Appeal No. 1094 of 2012 were heard together. After hearing the Division Bench vide judgement and order dated 15.09.2012 dismissed both the Letters Patent Appeals.
5.0 Very same prayers are made in the present petition and the issue has now been concluded by the Division Bench of this Court. Therefore for the reasons stated in the judgement and order dated 15.09.2012 in Letters Patent Appeal No.921 of 2012 and other allied matters the present petition deserves to be dismissed.
6.0 Accordingly the petition is dismissed. Rule is discharged with no order as to costs.
