Shri Ram Shiromani Yadav, Advocate, has filed his appearance on behalf of opposite party No.2. The same is taken on record.
Heard learned counsel for the applicants, Shri Ram Shiromani Yadav, learned counsel for the opposite party No.2 and learned AGA for the State.
This application u/s 482 Cr.P.C. has been filed with the prayer to qash the entire proceedings of Complaint Case No. 3957 of 2018 (Anil vs. Har Govind and others) under Sections 452, 307, 323, 392, 427 IPC, P.S.-Rajpura, District Sambhal as well as impugned summoning order dated 4.12.2018, passed by Civil Judge (Junior Division)/Judicial Magistrate, Sambhal, Chandausi.
After hearing learned counsel for the parties and after perusing the averments made in the present application, no case for any interference has been made out. Accordingly, the prayer, as made above, is refused.
However, without expressing any opinion on the merits of the case, it is directed that in case the applicants appear and surrender before the court-below and apply for bail, their prayer for bail shall be considered and decided expeditiously.
With the aforesaid direction/observation, the instant application u/s 482 Cr.P.C. is disposed of finally.
