Writ petition has been filed for issuance of mandamus directing the S.S.P.,Varanasi, respondent no. 2 and Circle Officer, Shivpur ,District Varanasi, respondent no.3 to ensure fair and impartial investigation in case crime no. 442 of 2018 under section 147,302,201 I.P.C., Police Station- Shivpur, District Varanasi.
It has been stated that F.I.R. was lodged on 31.7.2017 and the police is not proceeding in the matter.
In the facts of the case, writ petition is disposed of finally with the direction that S.S.P.,Varanasi, respondent no. 2 shall ensure fair and impartial investigation of case crime no. 442 of 2018 under section 147,302,201 I.P.C., Police Station- Shivpur, District Varanasi and submission of police report under section 173(2) Cr.P.C.in it as early as possible.
