Heard Sri Atul Srivastava who appears on behalf of the petitioner. Sri Krishna Mohan Asthana has accepted notice on behalf of respondent no. 1 United Bank of India.
As a consequence to the award of the Motor Accident Claims Tribunal, Ghaziabad dated 13.7.1999 the amount of the compensation was invested in the bank in a fixed deposit. On maturity of the said fixed deposit, the interest has been paid to the petitioner but as the said amount could not be reinvested in the fixed deposit for any further period, the petitioner has suffered loss of interest inasmuch as the amount still continues with the bank as the child has not attained majority. In any case, if the directions of the Tribunal have not been properly followed either by the Nazir or the bank resulting in loss of interest to the petitioner, the appropriate remedy of the petitioner is to move an application before the Claims Tribunal.
The writ petition is disposed of.
