Heard learned counsel for the parties.
From the perusal of the record, the position which emerges out is to the effect that the respondent-applicant filed a Regular Suit No. 677 of 2014 under Section 281 of the Muslim Law for the restitution of conjugal rights in the Family Court, District- Faizabad. To the aforesaid, the respondent has filed the objection/application registered as 23-Ga, inter alia, taking ground therein that the respondent-applicant married her against her will and in view thereof, the marriage is to be declared null and void.
The aforesaid objection/application was decided by the Family Court, Faizabad vide order dated 18.04.2017. Relevant portion of the order dated 18.04.2017 reads as under:-

Taking into consideration the facts of the case and findings given by the Trial Court, while rejecting the application of the appellant registered as 23-Ga, we are of the view that the Family Court has given just reasoning that the issue raised in the application can be decided only on the basis of the evidence led by the parties in the matter in question and at this stage, the application is not maintainable.
We do not find any infirmity or illegality in the reasoning given by the Family Court in the order dated 18.04.2017, by which the appellant's application registered as 23-Ga has been rejected.
In view of the above, the appeal is dismissed.
The Trial Court is directed to decide the matter, expeditiously say within one and a half year from today in accordance with law.
