JUDGMENT / ORDER

(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) After hearing the learned counsel for the parties and after going through the materials on record, we pass the following interim order for the present :
The petitioners will file an application before the Gujarat Pollution Control Board (GPCB) within one week for permission to run on trial basis. The GPCB, within seven days of receipt of such application, will consider such prayer and, if satisfied, will pass necessary permission for run on trial basis for a period of one month from that date. In the meantime, the GPCB will also be entitled to revisit the premises of the unit of the petitioners and to see whether the unit has complied with all the formalities as required under the law and will submit a report by June 21, 2012. If GPCB is not satisfied at the initial stage on the question of grant of consent then there will be no permission to run on trial basis.
Let the matter appear on June 21, 2012.
Direct service to GPCB is permitted.
A copy of this order be served upon the electricity company so that the petitioners are favoured with electricity in the event the GPCB grants permission.
