The order impugned in this writ petition passed by the District Magistrate, Ballia in exercise of power under Section 72 of the Excise Act, is appealable under Section 72 Sub-section 7 of the Excise Act.

In view of the existing statutory alternative remedy available to the petitioner, we are not inclined to interfere in the matter and the writ petition stands dismissed accordingly with aforesaid liberty.
