ORDER:
This writ petition is filed for a Mandamus to declare the inaction of respondents 2 to 4 in preventing respondent No.5 from carrying on fish/ prawn culture over 0.80 cents of land in Sy.No.26/3 of Gollapalem Village, Kajuluru Mandal, East Godavari District, as illegal and arbitrary.
At the hearing, the learned Assistant Government Pleader for Fisheries, on instructions, submitted that respondent No.5 has unauthorizedly converted his land into fish/prawn pond and applied for permission, that the Mandal Level Committee has rejected his application and forwarded the same along with its decision to the District Level Committee for approval of its decision and that pursuant to the rejection by the Mandal Level Committee, respondent No.5 is being permitted to carry on fish/prawn culture. He has further submitted that the official respondents will ensure that respondent No.5 will not carry on fish/prawn culture unless and until permission is granted to him by the higher level committees.
The above-noted statements of the learned Assistant Government Pleader are placed on record and the writ petition is accordingly disposed of.
As a sequel to the disposal of the writ petition, W.P.M.P.No.38086 of 2014 shall stand disposed of as infructuous.
