Heard learned counsel for the applicant and learned AGA for the State-respondents.
The present bail application has been filed for enlarging the applicant on bail in Case Crime No. 518 of 2019, under Section 307, 504, 506 I.P.C., Police Station -Shahbad, District -Rampur.
It is contended by learned counsel for the applicant that earlier victim has borrowed some money from the applicant and when applicant demanded the same, he has falsely implicated in the present case. The applicant has no criminal history. He also submitted that applicant is languishing in jail since 27.11.2019.
Per contra, learned A.G.A. has vehemently opposed the bail application and submitted that prosecution version as well as statement of injured is fully getting support from the medical report. Knife used in the said offence is also recovered. It is further submitted that injury report clearly shows that there is two incise wounds, 7 Cm x 1Cm right side just over the neck and 6 Cm x1 Cm skin deep left side over the neck. Therefore, no case is made out for granting bail.
Considering the facts and circumstances of the case, criminal history of the applicant, the gravity of the offence, the nature of accusations and severity of punishment in case of conviction, there does not appear any good ground to release the applicant on bail.
At this juncture, learned counsel for the applicant prayed that the trial is proceedings at snail's speed, hence the trial court be directed to conclude it within some time bound period.
However, the trial court is directed to make all possible efforts to conclude the trial expeditiously, if possible, within a period of six months from the date of production of computer generated copy of this order.
