Heard learned counsel for the petitioner and Sri S.K. Pandey, learned Standing Counsel appearing for the respondents.
Present writ petition has been filed seeking a direction to the respondent no. 2, the Commissioner, Agra Division, Agra to immediately decide Revision No. 204 of 2007, Chanchal Kumar and others Vs. State of U.P. filed under Section 56 of the Indian Stamp Act, pending before it and not to initiate the recovery proceedings against the petitioner in pursuance to the order dated 24.2.2007 passed by the respondent no. 3 filed as Annexure-2 to the writ petition.
Considering the facts and circumstances of the case, this writ petition is finally disposed of with a direction to the respondent no. 2, the Commissioner, Agra Division, Agra to consider and decide the aforesaid revision filed by the petitioner, in accordance with law, as expeditiously as possible, preferably within a period of three months from the date of production of a certified copy of this order before him.
From the copy of the revision it is not clear as to whether the petitioner has deposited the amount as required while filing the revision.
In view of the assertion that the recovery certificate has been issued, the petitioner is permitted to file an application for interim relief alongwith the amount required to be deposited during pendency of the revision, which shall be considered by the revisional authority, in accordance with law.
No costs.
