Undisputedly the fourth respondent is the recorded beneficiary in the service record of the deceased government servant. The petitioner presently who holds no declaration in recognition of her rights to claim family pension, claims to be the legally wedded wife of the deceased employee.
Be that as it may and as long as the rights of the fourth respondent stand duly preserved in terms of the service record maintained by the respondents, the writs as prayed for cannot possibly be granted.
Accordingly while this petition is dismissed it is left open to the petitioner to seek an appropriate declaration from the competent court if so chosen and advised.
