IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH FRIDAY, THE TENTH DAY OF OCTOBER TWO THOUSAND AND FOURTEEN Present HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.30307 of 2014 Between:
Chamarthy Sudhakar Raju, S/o. Venkata Rama Raju, Age 27 years, R/o. Thipparajupalli VI, N.R. Palli PO, Akepadu, Rajampet Mandal, Kadapa District.
.. Petitioner AND Government of Andhra Pradesh, Rep. by its Secretary, Ministry of External Affairs, South Block, Akbar Bhawan, New Delhi – 110 021 & another .. Respondents The Court made the following:
HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.30307 of 2014 ORDER:
The petitioner was granted Passport bearing No.E7563792 on 07.02.2004, which was valid for a period of 10 years. Passport so granted expired on 04.02.2014. While applying for renewal of passport, the petitioner noticed that in the passport granted to him his date of birth was recorded as 20.06.1991, whereas his actual date of birth is 01.07.1986. The petitioner avers that he passed 10th class and obtained Secondary School Certificate on 30.04.2004. The Secondary School Certificate would disclose the date of birth as 01.07.1986. Thus, while applying for renewal of passport, the petitioner has enclosed the relevant documents in support of his claim that wrong entry of date of birth was made. When the petitioner applied for original passport, he was minor. Learned counsel for the petitioner submits that the petitioner has submitted an application for renewal of passport on 25.08.2014, but so far no orders are passed.
2. Having regard to the fact that an application for grant of renewal of passport was submitted and the same is pending consideration, the Writ Petition is disposed of, without expressing any opinion on merits, directing the Regional Passport Officer, Secunderabad (2nd respondent) to pass appropriate orders, as warranted by law, on the application received by the 2nd respondent on 25.08.2014 within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
