The present 482 Cr.P.C. application has been filed to quash the entire criminal proceedings against the applicant in Sessions Trial No. 330 of 2018, arising out of Case Crime No. 255 of 2013 (State Vs. Yogesh Kumar Tiwari and another) under Sections 323, 325, 506 IPC and under Section 3(1) (10) SC/ST Act, P.S. Kokharaj, District Kaushambi and also for quashing the congizance order dated 16.1.2014 whereby the trial court has taken cognizance.
Learned counsel for the applicant submits that he has been falsely implicated by the police under the alleged sections.
In that view of the matter, he is permitted to move discharge application through counsel before the trial Court within three weeks from today and the trial court shall decide the same within a period of one month from the date of filing of application alongwith certified copy of this order.
Till the discharge application is decided, no coercive measures shall be taken against the applicant.
With the aforesaid observations, this application is disposed of.
