ORDER:
This Writ Petition is filed for the following substantive relief:
“to issue an appropriate order or direction more particularly in the nature of writ of Mandamus declaring the action of the first respondent in not declaring petitioner results of the second semester exam of first year B.E and further, not allowing petitioner to attend the Second year classes and also refusing to receive the requisite college fee from the petitioner as illegal, arbitrary, abuse of process of law and against the principles of natural justice and consequently, to direct respondent Nos.1 and 2 to declare the results of second semester exams and allow the petitioner to attend the classes of the second year B.E course for the academic year 2014-15 by collecting the requisite college fees from the petitioner.”
Having realised that a second Writ Petition in the form of the present one is not maintainable as the petitioner’s earlier Writ Petition No.25077 of 2014 is pending, Sri A.Tulsi Raj Gokul, learned counsel for the petitioner, requested for permission of this Court to withdraw the Writ Petition with liberty to his client to pursue the pending Writ Petition.
The Writ Petition is, accordingly, dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to dismissal of the Writ Petition, W.P.M.P.No.34333 of 2014 filed by the petitioner for interim relief stands dismissed as infructuous.
