Heard Sri Mithilesh Kumar Shukla, learned counsel for applicant and learned A.G.A. for State.
This application under Section 482 Cr.P.C. has been moved with direction to direct the Additional Chief Judicial Magistrate, Court No.1, Mathura to decide the Criminal Case No. 3840/IX of 2018 (State Vs. Chakresh Rajouria) arising out of Case Crime No. 152 of 2018, under Section 3 of U.P. Public Examination Act, 1998, P.S.-Baldev, District-Mathura.
Learned counsel for the applicant contended that the charge sheet has been submitted against the applicant on 17.07.2018, since then case is pending before the Court below and he is suffering in this case, a suitable direction may be given to decide the aforesaid case in stipulated period.
Learned A.G.A. has no objection to issue any direction in this case.
After hearing the learned counsel for the parties and after perusing the material on record, no useful purpose would be served in keeping the petition pending which is finally disposed off with a direction to direct the Additional Chief Judicial Magistrate, Court No.1, Mathura to decide the Criminal Case No. 3840/IX of 2018 (State Vs. Chakresh Rajouria) arising out of Case Crime No. 152 of 2018, under Section 3 of U.P. Public Examination Act, 1998, P.S.-Baldev, District-Mathura, strictly in accordance with law after hearing the parties and without granting any unnecessary adjournment to either the parties, expeditiously preferably within six months from the date of production of a certified copy of this order before him, provided the proceedings are not stayed by any Court of law.
With the aforesaid direction, the instant application under Section 482 Cr.P.S. is finally disposed of.
