Heard learned counsel for the parties.
Petitioner, a Constable in Civil Police, came to be terminated on 6 August 1994, by the instant writ petition, petitioner seeks a direction to the respondent to release the G.P.F.
On specific query, learned counsel for the petitioner submits that the terminated employee is not entitled to gratuity.
Learned Standing Counsel submits that the second respondent shall consider the claim of the petitioner provided the records of the petitioner is available.
In view thereof, on consent, the petition is disposed of directing the second respondent to consider and decide the representation of the petitioner by reasoned and speaking order, expeditiously, preferably within a period of three months from the date of filing of certified copy of this order alongwith copy of the writ petition.
It is clarified that the Court has not considered the claim of the petitioner on merits.
