JUDGMENT / ORDER

The petitioner is a senior citizen, aged 102 years. The grievance of the petitioner in this writ petition concerns the encroachment made by the third respondent to the Panchayat road and the public pond adjacent to the road. Ext.P3 communication issued by the Secretary of the Panchayat to the Deputy Director of Panchayat indicates that Panchayat is unable to take action against the encroachment on account of their inability to identify the encroachment and that a decision has been taken by the Panchayat as early as on 29.9.2012 to measure the property and identify the encroachment with the aid of the Taluk Surveyor. 2. In the aforesaid circumstances, the writ petition is disposed of directing the second respondent to identify the encroachment, if any, made by the third respondent as sought for by the Panchayat, within six weeks from today. On receiving the report of the second respondent, the Panchayat shall take W.P(C) No. 22067 of 2014 2 consequent follow-up action for eviction of the encroachment, if any, within six weeks thereafter.
