JUDGMENT / ORDER

The Petitioner seeks transfer of a complaint filed before the District Consumer Disputes Redressal Forum, Thoothukudi. Section 17-A of the Consumer Protection Act empowers of State Consumer Disputes Redressal Commission to entertain Petitions seeking transfer of case from one District Forum to another District Forum. Section 24 of the Civil Procedure Code empowers this Court and the District Court to transfer proceedings from a Court, which means a Civil Court. Therefore the Petitioner cannot invoke Section 24 of Civil Procedure Code for transfer of a proceeding pending before a Consumer Forum. Hence this Transfer Civil Miscellaneous Petition is dismissed. However, the Petitioner is at liberty to move the State Consumer Disputes Redressal Commission, a Petition under Section 17-A of the Consumer Protection Act, if so advised. Consequently Consequently, connected Miscellaneous Petition is dismissed. No costs.
