JUDGMENT / ORDER

ORDER:
This contempt case is filed alleging willful disobedience of order dated 26.12.2011 in W.P.No.16022 of 2010, as modified by order dated 06.03.2012 in W.P.M.P.No.1925 of 2012.
At the hearing, respondents 5 and 6 are present. The learned Government Pleader for Irrigation submitted that on pursuance made by the respondent No.6, the Finance Department of Government of A.P. has issued the L.O.C. and that the payments will be made shortly. In paragraph 8 of the counter-affidavit filed by respondent No.6, he has stated as under:
“I submit that I requested the government through letters dated 12-3-2014 and 9-4-2014 for release of L.O.C. it is submitted that the Finance Department approved L.O.C. on 26.04.2014. I submit that by today, we are likely to receive the budget release order. It is submit that payment would be made to the petitioner within a period of one week. The respondent herein tenders unconditional apology for the delay in implementation of the order.”
Though respondents have not adhered to the time limit stipulated in the order dated 26.12.2011 in W.P.No.16022 of 2010, having regard to the above-noted undertaking given by respondent No.6, the contempt case is closed, with liberty to the petitioners to seek revival of the contempt case in the event payment as assured by respondent No.6 in the above reproduced part of the counter-affidavit is not made.
The respondents are accordingly discharged from the contempt proceedings.
