HONOURABLE THE CHIEF JUSTICE MR. BHASKAR BHATTACHARYA) This Appeal under Clause 15 of the Letters Patent is at the instance of an unsuccessful applicant of Special Civil Application filed under Article 227 of the Constitution of India, by which the appellant challenged the award dated 25th May 2012 passed by the Central Government Industrial Tribunal cum Labour Court.
It appears that the petition having been filed under Article 227 of the Constitution of India and the learned Single Judge having refused to interfere with the award by entering into merit, we are convinced that the present Appeal is not maintainable against such an order passed in exercise of powers under Article 227 of the Constitution of India.
On that ground alone, we dismiss this Appeal. We make it clear that we have otherwise not gone into the merits and dismissal of this Appeal will not stand in the way of the appellant in seeking appropriate remedy before appropriate forum in accordance with law.
