There is a short delay in filing of this appeal. Cause shown for delay in filing of this appeal is sufficient. The delay in filing the appeal is condoned. The defect is removed.
The appellant has approached this Court after three years relying on a judgment of the Madras High Court. The learned Single Judge has rightly recorded that there is an immense delay in raising the claim and that too on the basis of the subsequent judgment. We are not inclined to interfere in the order of the learned Single Judge.
The Special Appeal has no merit and it is accordingly dismissed.
