JUDGMENT / ORDER

HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH PRESENT THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NOs.21933 AND 21965 OF 2014 DATED:19.9.2014 Between:
M/s. Chabbra’s Associates A Partnership Firm Represented by its Partner Sri Ramesh Chabbra having office at # No.11-1-776/14, Chilkalguda Secunderabad … Petitioner And Union of India Rep. by the Executive Engineer (Electrical) Hyderabad Central Electrical Division-II CPWD, Nirman Bhavan, Sultan Bazaar, Koti Hyderabad and others … Respondents THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NOs.21933 AND 21965 OF 2014 COMMON ORDER: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) These writ petitions are summarily dismissed as we are of the view that this is sheer abuse of process of Court since the petitioner has got alternative remedy under the Arbitration and Conciliation Act, 1996, if the provisions of Sections 32, 33 and 34 of the aforesaid Act are checked up properly. It appears from the record that on the last occasion learned counsel for the petitioner took time to check up relevant provisions of law but nothing was done. It would be open for the petitioner to approach appropriate forum in accordance with law, as may be advised.
Pending miscellaneous petitions, if any, shall also stand dismissed. There will be no order as to costs.
K.J. SENGUPTA, CJ SANJAY KUMAR, J 19.9.2014 bnr
