ORDER:
The writ petition is directed against the order in Memo No.21146/Asn.II(2)/2005-12, dated 10.08.2009. Through the order impugned in the writ petition, the 1st respondent vacated the stay order granted through order dated 19.05.2006.
This Court on 29.10.2009 directed the parties to maintain status quo as on the date till further orders. Respondent Nos.5 to 11 have filed petition to vacate the interim order dated 29.10.2009.
Having regard to the limited grievance the parties have at this juncture, with the consent of learned counsel, the writ petition is taken up for hearing and disposal.
The petitioner being aggrieved by the order of CCLA dated 13.03.2006 filed revision before the 1st respondent. At the first instance, through order dated 19.05.2006, the interim stay of operation of the impugned order was granted and the same was vacated on 10.08.2009.
In the opinion of this Court, vacation of the order, when the matter is ripe for hearing, causes prejudice to the petitioner and the revision would also become infructuous or lead to further complications. Be that as it may, this Court through order dated 29.10.2009 directed maintenance of status quo by the respondents. Therefore, I direct the 1st respondent to dispose of the revision pending in Memo No.21146/Asn.II(2)/2005-12 within a period of four (04) months from the date of receipt of a copy of this order. The status quo granted by this Court on 29.10.2009 is directed to be maintained by both the parties, pending disposal of the revision.
The learned counsel appearing on both sides tried to pursuade this Court that there are few subsequent events, which either make or mar the result of the revision. Both parties are given adequate opportunity to file such other or further material in the revision in support of their case.
With the above observations, the Writ Petition is disposed of. No order as to costs.
Consequently, miscellaneous petitions filed in this writ petition shall stand dismissed.
