Order:
This Writ Petition is filed for the following substantive relief:
“to issue a writ of Mandamus or any other appropriate writ, order declaring the action of Respondent Nos.1 & 2 in charging more electricity charges than the stipulated tariff by the APERC in the light of the order passed by the Vidyut Ombudsman in OA No.110/2013, dated 29.5.2014, as illegal, arbitrary and without jurisdiction and further direct the Respondents to collect the charges from the Petitioner in relation to the Service Nos.1501 37624 to 1501 37628 and 1501 36095, as fixed by the APERC and direct the Respondents to adjust the excess amounts paid by the petitioner in future bills.”
At the hearing, it is not disputed by the learned Counsel for both the parties that the issue similar to that raised in this Writ Petition viz., demanding more electricity consumption charges than the tariff stipulated by the APERC only on the ground that the petitioner did not secure Occupancy Certificate from the Greater Hyderabad Municipal Corporation of Hyderabad, was decided by this Court vide W.P.No.32906 of 2014, dated 05.11.2014.
For the same reasons as contained in the aforesaid order, this Writ Petition is disposed of with the direction that the reasons and directions contained therein shall form part of this order.
As a sequel, WPMP.No.42205 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
