THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.30819 of 2014 ORDER :
The limited grievance of the petitioner in this writ petition is that the petitioner presented the document on 31.05.2014 for registration, the same was registered on 02.06.2014 vide document bearing No.2379 of 2014. This document concerns 400 Square yards of land in Panasapadu Village limits in R.S.No.159/10B, R.S.No.159/11B. Even though the document was registered, so far it is not released and no valid reason is furnished to the petitioner for not releasing the document which is registered. Several representations are submitted by the petitioner. The representations dated 16.07.2014, 23.07.2014 and 24.07.2014 are enclosed to the material papers. These representations are submitted to the Sub-Registrar, Sarpavaram, Kakinada, Deputy Inspector General, Registrations and Stamps, Kakinada, District Registrar, Kakinada, and District Collector, Kakinda, but so far no orders are passed on the said representations.
2. Learned counsel for the petitioner submits that on account of inordinate delay in releasing the document which legally belongs to the petitioner, he is subjected to lot of hardship and suffering for no fault of him.
3. On 15.10.2014 the matter was adjourned at the request of learned Government Pleader to get instructions as to why the document is not released. Learned Government Pleader, expressed her inability to make submission as the instructions are not furnished to her.
4. Having regard to the fact that that the representations submitted by the petitioner on 16.07.2014, 23.07.2014 and 24.07.2014 are stated to be pending and not disposed of, without expressing any opinion on merits, this writ petition is disposed of directing the District Registrar, Kakinada (3rd respondent) herein, to pass orders on the representation submitted by the petitioner on 23.07.2014 and communicate the decision to the petitioner within a period of three (3) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
5. Miscellaneous Petitions, if any, pending in this writ petition shall stand dismissed.
