Heard learned counsel for the parties.
Challenge has been raised to the recovery of Rs. 3,95,462/- being pressed against the petitioner towards electricity dues.
At the outset, solitary prayer made on behalf of the petitioner is that the petitioner is willing to pay the entire amount in installments.
From perusal of record, it appears that the the correct amount being claimed against the petitioner is Rs. 3,85,462/-, as mentioned in the demand notice dated 01.08.2021 and not Rs. 3,95,462/- as mentioned in the recovery citation, dated 09.08.2021.
In view of the offer made by the petitioner, no useful purpose would be served in keeping the present petition pending or calling for a counter affidavit, at this stage.
Accordingly, the writ petition is disposed of with the following directions:
(i) the petitioner shall pay a sum of Rs. 85,462/- before the respondent-Corporation on or before 30 November 2021;
(ii) the balance amount may be paid in three equal installments of Rs. 75,000/- each payable on or before 31 December 2021, 31 January 2022, 28 February 2022 and 31 March 2022 respectively.
No coercive measure shall be adopted against the petitioner with respect to the recovery citation dated 09.08.2021, subject to their compliance with the terms of this order.
