The present writ petition is filed for a mandamus declaring the action of the 2nd respondent in issuing the distraint order dated 28-01-2014 for sale of properties of the petitioners and their family members in violation of and contrary to the provisions of the Revenue Recovery Act, 1864 as illegal and arbitrary and for a consequential direction to set aside the impugned order dated 28- 01-2014.
2. The writ petition was heard at length along with connected writ petitions W.P.Nos.5894 of 2014 and 1121 of 2014 and reserved for judgment on 11-09-2014. After reserving the matter along with said writ petitions and when W.P.Nos.5894 of 2014 and 1121 of 2014 are reopened for recording that in view of subsequent orders passed by the District Collector, Adilabad on 29-10-2014, the learned counsel for the petitioners seeks permission of the court to withdraw the writ petition with a liberty to file a fresh writ petition on the ground that in view of subsequent orders dated 29- 10-2014 passed by the District Collector, Adilabad, the issue involved herein no longer survives and has become infructuous.
Permission is accorded.
Accordingly, the writ petition is dismissed as withdrawn giving liberty to file a fresh writ petition. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
