JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) THURSDAY, THE SEVENTH DAY OF AUGUST TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 20526 of 2014 BETWEEN Ch.Sambasiva Rao and another AND ... PETITIONERS The Government of Andhra Pradesh, Rep. by its Principal Secretary (Department of Revenue), A.P. Secretariat Building, Hyderabad and others.
...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. Petitioners approached this court by the present writ petition alleging that the respondent-police are interfering with the civil disputes of the petitioners and private parties, which was subject matter of O.S.No.106 of 2011 on the file of XI Additional District Judge, (Fast Track Court) , Guntur. For the same relief, petitioners had earlier approached this court in W.P.No.31642 of 2011, wherein a specific counter affidavit was filed on behalf of the Tenali Rural Police Station, Guntur District, specifically stating that petitioners were not called to the police station nor pressurized nor there was any interference with the civil disputes between the petitioners and third parties. After recording the same, this court disposed of the said writ petition on 21.12.2011. However, petitioners state that after a gap of three years once again similar interference was found. Hence petitioners had to approach this court again.
3. On 23.07.2014 when this writ petition was heard, while requiring learned Government Pleader to get instructions in the matter, respondent Nos.3 and 4 were directed to abide by the directions of this court in W.P.No.31642 of 2011, referred to above.
4. Learned government pleader has now received instructions, which reiterates that in terms of the directions of this court in the earlier writ petition, referred to above, no complaint was received against the petitioners and, as such, the question of summoning them to the police station does not arise. It is also stated that there is no interference with the civil dispute, much less the dispute of the petitioners herein with the third parties.
In view of the said specific instructions, no specific direction is called for in this writ petition and is, accordingly, disposed of directing respondent Nos.3 and 4 to ensure that the order of this court in W.P.No.31642 of 2011 dated 21.12.2011 is adhered to and followed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
