JUDGMENT / ORDER

1. One of the grievances voiced by Mr.Ravani, learned Counsel appearing on behalf of the Central Bureau of Investigation (hereinafter referred to as "CBI" for short) is that despite number of communications and requests, more particularly communications dtd.17/8/2011 and 30/8/2011, State is not providing the necessary facilities and infrastructures which are very much needed for expeditious completion of the case. It is submitted that by the aforesaid communications, the investigating officer of the CBI has requested to provide the following facilities and infrastructures for expeditious completion of the case :-
(1) Rent free accommodation of at least 6 (six) rooms for setting up the camp office and accommodation of the CBI team.
(2) 3 (three) light vehicles in good working conditions with drivers and fuel.
(3) 2 (two) desktop computers with internet modem connectivity along with 1 (one) laser printer.
(4) 1 (one) telephone with STD and FAX facilities at the camp office.
(5) 1 (one) liaison officer of the Inspector rank and adequate security arrangement for the CBI team at the CBI Camp Office, Ahmedabad.
2. It is further submitted by Mr.Ravani, learned counsel appearing on behalf of the CBI that even the investigating officer has personally met and requested the highest officer of the State i.e. Chief Secretary, State of Gujarat, however, there is no response at all.
3. In view of the above, NOTICE to respondent No.1 - State, to be served through the Secretary, Home Department as well as respondent No.2 - Director General of Police, State of Gujarat, making it returnable on 23/1/2012.

Dabhi, learned Additional Public Prosecutor waives the service of notice on behalf of the respondent Nos.1 and 2.
4. On the next date of hearing, State to respond to the aforesaid grievance of the CBI and state as to whether the State is going to provide facilities as requested by the concerned investigating officer of the CBI or not and if yes, within how much time the State shall also provide the aforesaid facilities, as it appears that whatever facilities are requested by the CBI are needed for expeditious completion of the investigation of the case.
Registry is directed to provide copy of this order to Mr.Dabhi, learned Additional Public Prosecutor to communicate the same to the respondent Nos.1 and 2.
