JUDGMENT / ORDER

1. In response to the order passed by this Court dated 19/01/2012 an affidavit is filed on behalf of the State affirmed by one Shri D.R. Patel, Under Secretary (Law and Order), Home Department, Sachivalaya, Gandhinagar submitting that the State Government was always ready and willing to provide all support and accommodation to the CBI. It is submitted that the State Government is doing its best to provide all infrastructure facilities and shall provide all infrastructure facilities as required by the CBI in their earlier communication within a period of 10 days from today.
2. Shri Jani, learned Public Prosecutor appearing on behalf of the State has stated that there was not a slightest intention on the part of the State to come in the way of CBI in further investigation of the case. It is submitted that the time has taken in correspondence as well as at the insistence on the part of the CBI to provide six rooms at circuit house for their office and accommodation of the Officers of the CBI. Shri Ravani, learned Counsel appearing on behalf of the CBI has denied the above. Be that as it may. In view of the stand taken by the State, which is reflected in the affidavit-in-reply and the following statement, it is not necessary to enter into any such dispute and/or allegations and/or counter allegations.

Shri Prakash Jani, learned Public Prosecutor appearing on behalf of the State has stated at the bar that a decision is already taken by the State Government on dated 21/01/2012 by which it has been decided to allot the place admeasuring 2200 sq feet at Patnagar Yojna Bhavan, Sector 16, Gandhinagar, which can be used by the CBI for their office purpose. It is submitted that the actual possession of the same shall be handed over to the CBI during the course of the day. It is further submitted that all other infrastructure facilities, as required by the CBI as per the communication dated 11/08/2011 and as mentioned in the communication addressed to the Managing Director, Gujarat State Police Housing Corporation dated 21/01/2012 (page 92-95), shall be provided within 10 ten days from today.

It is further submitted by Shri Jani, learned Public Prosecutor that the Deputy Commissioner of Police, State Control Room, Gandhinagar has already instructed the private team of six SRPs, which shall be at the disposal of the CBI and their services can be utilized by the CBI as per their requirement. The list of the names of such SRPs shall be submitted to the CBI by 24/01/2012 and on or from 31/01/2012 they shall be at the disposal of the CBI.

Shri Jani, learned Public Prosecutor has also further stated that for residential purpose three rooms at 'Vishram Gruh' in Ahmedabad and accommodation in circuit house shall be provided to the CBI and as and when required by the High Ranking Officers like DIG, DSP etc. It is further submitted that the State Government shall make all efforts to see that the residential accommodation is provided to the CBI for their Officers at Gandhinagar looking to the fact that they are allotted the office at Gandhinagar.
6. Shri Jani, learned Public Prosecutor has submitted that even after providing the aforesaid infrastructure facilities to the CBI, if the Officers of the CBI has any other difficulty they can approach the Additional Chief Secretary (Home), State of Gujarat and/or Shri D.R. Patel, Under Secretary (Law and Order), Home Department, Sachivalaya, Gandhinagar.
