Heard Sri Sahab Tiwari, learned counsel for the applicant, Sri J.N. Singh, learned counsel for the opposite party and Sri Azad Singh, learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed for quashing/stay the entire proceedings of Complaint Case No. 1242/2001, re-numbered as 510/03 and further re-numbered as 1300/04 (Kunwar Sen Vs. M/s Bharti Tractors Etah Road Shikohabad and others) under sections 420, 468, 471, 406, 409 IPC and 138 & 142 Negotiable Instrument Act, pending in the court of learned ACJM-II, Firozabad.
During the course of argument learned counsel for applicant has confined his prayer to direct the court below to consider and conclude the aforesaid case pending before Additional Chief Judicial Magistrate-II, Firozabad, expeditiously, preferably within the time stipulated by this Court.
After hearing the learned counsel for the applicant, learned counsel for opposite party and learned A.G.A. and after perusing the material on record, no useful purpose would be served in keeping the petition pending which is finally disposed off with a direction to the concerned court to consider and conclude the aforesaid case most expeditiously, if already not decided, strictly in accordance with law, after hearing the parties and without granting any unnecessary adjournment to either the parties, preferably within a period of six months from the date of production of a certified copy of this order before him, provided the proceedings are not stayed by any Court of law.
For a period of six months, no coercive action shall be taken against the applicant in the aforesaid case.
