… Respondent THE HON’BLE SHRI JUSTICE SANJAY KUMAR CONTEMPT CASE NO.1615 OF 2012 O R D E R It is conceded by the learned counsel appearing for the parties that no further order requires to be passed in this contempt case in the light of the later developments in the form of this Court permitting the Cement Corporation of India to pay retrenchment compensation to the individual workers who are the members of the petitioner association.
It is now stated that such commitment has been made good in most of the cases. However, Sri G.Ravi Mohan, learned counsel, would submit that five workers had died and the payment would therefore have to be made to their legal heirs. He would further submit that in similar circumstances, the Cement Corporation of India earlier undertook identification of the legal heirs through the Contractor concerned and settled the dues of the deceased worker. This aspect, however, would not fall within the ambit of this Court’s contempt jurisdiction.
The contempt case is accordingly closed leaving it open to the petitioner association to espouse the cause of the deceased workers before the Cement Corporation of India and thereafter take necessary steps in the matter in accordance with law as may be advised. No order as to costs.
