Petitioner has approached this court seeking direction to the first and second respondents to provide adequate police protection for the peaceful functioning of quarry and crusher unit and for transporting the materials to and fro therein, in view of the forceful obstruction by the respondents 3 to 10.
2. The petitioner firm is running a quarry and crusher unit.
The crusher unit is more than 15 kilometers away from the quarry; to which place, the extracted granite has to be transported. According to the petitioner, they have got all the required licenses, permits and NOC from the concerned departments/authorities. But respondents 3 to 10 are obstructing the operation and transportation of the materials alleging pollution.
3. Learned Government Pleader submits that the version of the petitioner is not at all correct. It is stated that on 6.5.2014, there was W.P.(C)No.13441 OF 2014 : 2 :
a 'Dharna' by the people of the locality against the illegal functioning of quarries at certain places, in general. But there is no threat to the law and order situation.
4. Heard learned counsel for the petitioner and perused the materials available on record.
In the facts and circumstances of the case and in view of the submission made by the learned Government Pleader that there is no threat to the law and order situation, this writ petition is disposed of, as no further order is necessary. It is made clear that, if any obstruction is caused by the respondents 3 to 10 or anybody under them, for the peaceful functioning of the quarry and crusher unit, it is open to the petitioner to approach the respondents 1 and 2, who in turn shall take all remedial measures, to meet the law and order situation.
