C.Durai vs The District Social Welfare ...

Madras High Court|05 September, 2017

JUDGMENT / ORDER

[Order of the Court was made by M.M.SUNDRESH, J.] The petitioner is the mother of the detenue. Even in the complaint given to the third respondent the petitioner has stated that her relatives came to see the detenue for the purpose of marriage. The detenue is aged about 17 years. On a complaint given by the third party, the first respondent visited the house of the petitioner and took away the detenue.
2.The learned Additional Public Prosecutor would submit that the detenue is under the custody of the first respondent as the petitioner has attempted to arrange marriage for the detenue despite being a minor. We do not find any illegal detention as the detenue is under the legal custody of the first respondent.
3. The fact that the petitioner also made an attempt to arrange marriage for the detenue is not in dispute. In such view of the matter, this Habeas Corpus Petition is closed.
To:
1.The District Social Welfare Officer, Collector Office, Trichy District.
2.The Superintendent, Minor Welfare Protection Home, E.B.Road, Trichy, Trichy District.
3.The Inspector of Police, Thuvarankurichi Police Station, Marungapuri Taluk, Trichy District.
4.The Additional Public Prosecutor, Madurai Bench of Madras High Court, Madurai..
