JUDGMENT / ORDER

The lands comprised in S.F.Nos.535/1 Part measuring 0.35 cent, in S.F.No.535/3 measuring 0.01 cents, in S.F.No.538/5 measuring 0.60 cents at Keelaiyur Village, Melur Taluk, Madurai District, were originally assigned to the petitioner's father under a Deed of Assignment dated 24.03.1980. After the death of the petitioner's father, the lands devolved on the petitioner and the other three children. Subsequently, the petitioner's two sisters and brother who are the respondents 3 to 5 had also given No Objection Certificate on 04.02.2011 stating that they have no objection, if the patta for the assigned lands is transferred in favour of the petitioner. Enclosing the Legal heirship certificate and the No Objection Certificate, the petitioner has made an application on 03.05.2012 to the 2nd respondent, seeking for transfer of patta in his favour.
2.In view of the fact that it is for the 2nd respondent to consider the petitioner's claim, it would be appropriate that direction be given to the 2nd respondent to consider the petitioner's application within a stipulated time.
3.Hence, the 2nd respondent is directed to consider the petitioner's application dated 03.05.2012 after giving notice to the respondents 3 to 5 and pass orders in accordance with law within a period of three months from the date of receipt of a copy of this order.
With the above direction, this Writ Petition stands allowed. No costs.
