JUDGMENT / ORDER

Petition filed under Section 482 Cr.P.C.
2. Petitioners are accused 4 & 5 in CC No. 942 of 2016 on the file of the Judicial First Class Magistrate, Malappuram, in which the allegation is that they along with the co-accused committed the offences under Sections 419, 465, 468 & 471 r/w Section 34 IPC. The proceedings are sought to be quashed on the ground that the facts of the case do not disclose commission of any offence by the petitioners and the dispute is of a civil nature.
3. Heard the learned counsel for the petitioners and the learned Public Prosecutor.
4. It is submitted that the case has now been posted for framing charge in the trial court. The proper remedy of the petitioners is to plead for discharge if the allegations in this Crl.M.C. are true.
In the result, this Crl.M.C. is dismissed. The petitioners may plead for discharge in the trial court.
