The petitioner has approached this Court with the following prayers:
“(a) Issue a writ of certiorari or any other writ or order to quash Ext.P1 notice of the 2nd respondent;
(b) Issue a writ of mandamus or any other writ, order or direction, directing the 1st respondent to issue certified copies of the orders and demand notice, if any passed, as requested in Ext.P2 application.
(c) Issue a writ of mandamus or any other writ, order or direction, directing the respondents not to take any steps to realise the amount demanded under Exhibit.P1 demand notice for one month enabling the petitioner to obtain certified copies of the orders and to approach statutory appellate authorities for relief.”
2. The case projected by the petitioner is that, demand has been raised without any assessment or serving a copy of the assessment order, if any. The version of the petitioner is sought to be rebutted by the learned Government Pleader, pointing out that the demand pertains to the assessment of October 2009, for a total sum of `4,86,765/-. It is also stated that, the copy of the assessment order was served to the party who has endorsed WP(c). No. 34735 of 2014 2 acknowledgment in the office records.
3. The learned counsel for the petitioner seeks for time to move the statutory authority after getting a certified copy.
In the above circumstances, interference is declined and the writ petition is dismissed; without prejudice to the rights and liberties of the petitioner to pursue appropriate remedy, in accordance with law. If any application is pending consideration for issuance of certified copy, the same shall be considered and necessary steps shall be taken forthwith.
