JUDGMENT / ORDER

Petitioner joined as Accounts Officer, Thrissur under the first respondent based on Ext.P2 order of promotion, on 01.06.2017. It is the case of the petitioner that he found out huge fraud and misappropriation committed by one Sruthi, a daily waged hand at the Sub Office of the Board at Kattur, which is under the Thrissur District Committee of the Board. He submitted Ext.P4 complaint before the Police Station, at Mathilikam and Ext.P3 FIR is registered against Smt.Sruthi on misappropriation of funds. It is stated that she transferred huge amounts of the Board to her account, and on the basis of timely detection of the defalcation, petitioner could stop the illegal activities of the daily waged hand. Even though, the petitioner was the person who detected the forgery W.P.(C)No.6996 of 2018 2 and misappropriation of funds, he was placed under suspension as per Ext.P4 order dated 24.11.2017 alleging administrative and supervisory lapses. Even though, petitioner submitted Ext.P5 representation before the 2 nd respondent, pointing out his grievances and requesting for reinstatement, no action was taken. It is stated not even a memo of charge was issued at the time when the writ petition was filed.
2. Learned Standing Counsel has filed a statement, stating that the petitioners are paid subsistence allowance and it would be very much premature to revoke the suspension orders at this point of time when investigations are yet to be completed.
3. The question whether the petitioners should be retained under suspension in the circumstances of the case even after four months of the suspension is to be examined by the second respondent. According to the petitioner, he is not in any way involved in the forgery or misappropriation committed by the daily waged hand.
4. Considering the facts and circumstances of the W.P.(C)No.6996 of 2018 3 case, there shall be a direction to the second respondent to consider and pass orders on Ext.P5 representation, after affording an opportunity of hearing to the petitioner, within a period of three weeks from the date of receipt of a copy of the judgment.
The writ petition is disposed of as above.
